1. Agreement to these terms
These Terms of Service ("Terms") govern your use of Seamesy, the website and services at seamesy.com operated by Veilant Access LLC, a New Jersey limited liability company, under the name Seamesy ("Seamesy", "we", "us") that connect buyers with independent fashion designers ("Designers") based in Nigeria, Ghana and other locations we add over time. By creating an account, sending a request, placing an order or opening a designer store, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Seamesy.
Please read section 22 carefully. It says disputes with Seamesy are settled by binding individual arbitration or in small claims court, not by a jury or a class action, and explains how to opt out. Sections 18 and 19 also limit what Seamesy is responsible for.
2. Seamesy's role
Seamesy is a technology platform and marketplace that acts as an intermediary between buyers and Designers. Designers are independent businesses, not Seamesy employees, agents or partners, and Seamesy is not the maker or seller of their pieces. We provide the platform, order messaging, the payment arrangement described in section 7, and the dispute process in section 11 that let a buyer and a Designer agree on a custom piece and see it through.
What Seamesy does not do. Seamesy does not source or cut fabric, take or check measurements, sew or finish garments, or pack, book, carry or manage shipping. The Designer does that work and is solely responsible for it: the quality and accuracy of the piece, meeting the completion date in their quote, and getting the piece shipped or handed over. The one exception is the optional Seamesy Lagos Hub storage you can ask for under section 8, and only for the storage itself. See sections 18 and 19 for what this means for Seamesy's liability.
3. Accounts
You must be at least 18 to use Seamesy. Give accurate information when you create an account and keep your login details secure; you're responsible for activity under your account. Each account is either a buyer account or a Designer account. A Designer who wants to order a piece uses a separate buyer account. If Seamesy approves a Designer application from an email address that already has a buyer account, that account becomes a Designer account; its earlier orders stay on it and can still be viewed. Tell us at support@seamesy.com straight away if you think someone else has accessed your account.
Order and account emails (quotes, messages, status updates, review windows, dispute and cancellation outcomes, Designer verification results, and any suspension, ban or lifting of a restriction on your account) are part of the service and can't be switched off while you have an account. Marketing emails are optional.
Some account details are locked to protect orders. The country on your account is set the first time you save your profile and can't then be changed by you. A buyer can't change their name while they have a paid order in progress. If either needs correcting, contact Seamesy support. A password-reset link only lets you set a new password; you'll need to finish that, or sign out, before using the rest of your account.
4. Requests, quotes and orders
When you send a request, Seamesy shares your brief, reference photos and any measurements you include with the Designer you choose. The Designer may reply with a quote listing the garment cost, the shipping cost (with the estimated package weight for international shipping) and an estimated completion date at least 7 days away, or decline. A quote may be above the budget you gave; custom work often costs more than expected, and you are free to decline it. A Designer can revise a sent quote up to two times.
Quotes are held for 72 hours. Exchange rates for the Naira and the Cedi change every day, so a quote can only be paid within 72 hours of being sent or last updated. After that it expires and nothing is charged. You can ask the Designer for a refreshed quote from the order page, and the new quote gives you a fresh 72 hours.
Accepting a quote (price and completion date together) and paying creates a binding order between you and that Designer, facilitated by Seamesy. Designers are expected to keep buyers updated and deliver by the date they committed to, but Seamesy does not guarantee any turnaround time, and delays can happen with handmade work.
Requests can only be sent to a Designer whose store is live (verified by Seamesy). You can discard an unsent request at any time.
Group orders (Aso Ebi). A buyer can share a group link from their order so friends or family can order the same design from the same Designer. Each person who uses the link places their own separate order, with their own quote, measurements, delivery, payment and protections under these Terms; nobody pays for anyone else's order through Seamesy. The person who shared the link can see each member's first name and order progress, but never their price, measurements or address. A group link stops working if the original order is declined or cancelled.
Overdue orders. If the estimated completion date arrives and the piece hasn't been shipped or made ready for pickup, the order is marked "Due today" and then "Overdue" for both of you, along with whose step the order is waiting on. Seamesy may post check-in messages in the order chat while an order is overdue, and may step in if it stays stuck. See section 13 for how late delivery affects a Designer's payout.
5. Pricing and fees
At checkout Seamesy adds a Buyer Protection Fee to the Designer's quote, shown as its own line, and you see the full total before you pay. Local Pickup has no shipping cost. You won't be charged more than that total, except for a budget increase you agree to under section 6, and any customs duties or import taxes on international shipments (section 8). Designers pay a 5% platform fee, taken from their payout on completed orders. Fees are worked out on the exact amounts and rounded only to the cent when you pay. All charges are made in US dollars; prices shown in another currency are an approximate conversion for your convenience.
6. Budget increases after a quote is accepted
After an order starts, a Designer may ask for a budget increase through the order page, giving the amount, the reason and one of two categories:
- Shipping Correction. Capped at 20% of the original order value, and allowed only once per order. Its main use is a Volumetric Weight Adjustment (below).
- Buyer-Requested Design Addition. For something you asked to add after the quote was agreed (for example, extra beading). No cap, but it needs your explicit approval.
Only one request can be pending at a time, and nothing is charged without your agreement. If you approve, you pay the extra amount on the order page, and it's held with the rest of your payment under section 7. Once it's paid, it's added to the Designer's payout (less the 5% platform fee) and released with the held balance. If you decline, the order continues at the original price, and the Designer must still deliver the originally agreed design and timeline. These limits apply only after a quote is accepted; they don't cap a Designer's initial quote.
Volumetric Weight Adjustment. Couriers and cargo agents charge by the actual weight of the packed parcel or by its volumetric (size-based) weight, whichever is higher. Sometimes the finished, packed piece comes in heavier than the weight the Designer quoted. In that case the Designer may ask for a Shipping Correction to cover the difference, explaining it on the order page. This is an emergency measure, not standard practice: Designers are expected to quote shipping accurately and to build a small buffer into their shipping quote so it isn't needed. If you agree, you pay the extra on the order page as above. If you decline it, or agree but don't pay it within 48 hours:
- Your order is not cancelled, and a declined Shipping Correction is not, by itself, a reason for a refund. If you decide to cancel instead, it's treated as a change of mind under section 12.
- Seamesy does not automatically pay the difference, and nothing is automatically taken off the Designer's payout.
- The Designer chooses either to send the piece at the original shipping price and cover the extra cost themselves (their payout is unchanged), or to ask Seamesy to step in.
- If Seamesy steps in, it works with you both through the Seamesy support chat and decides case by case. Options include switching to a cheaper delivery option such as Standard Cargo, splitting the difference, delivery to a local address you nominate, or, with your agreement, storage at the Seamesy Lagos Hub (section 8) until it's sorted. If no solution is agreed within 14 days of Seamesy stepping in, Seamesy will decide how the piece is sent and who pays the difference, acting fairly to both sides. Seamesy is not required to pay the difference itself.
While this is being sorted, the order shows whose step it is waiting on, and time spent waiting on Seamesy to resolve it is not counted against the Designer under section 13.
7. Payments and the payment hold
How payment works. Seamesy is a technology platform, not a bank, money transmitter or escrow agent. Card payments are processed by Stripe, a third-party payment processor. When you accept a quote you pay 100% of the order total in one card payment, which is taken straight away (it isn't a pre-authorisation). The money is paid to Seamesy, not to the Designer: Stripe settles it into Seamesy's own Stripe account and then to Seamesy's business bank account on Stripe's normal schedule.
How Designers are paid. Seamesy pays Designers itself, by bank transfer to the verified payout account the Designer gave us (section 13). Designers aren't paid through Stripe and never receive your card details. When these Terms say Seamesy "holds" a payment, they mean Seamesy keeps the Designer's share in its own accounts and only sends it when the order reaches the milestones below. Bank transfers can take a few business days to arrive after Seamesy sends them.
Seamesy collects payment for the Designer. Each Designer appoints Seamesy as their limited agent to accept payment from buyers for their orders. Once your payment to Seamesy succeeds, you have paid the Designer for that order, and the Designer can't ask you to pay again or pay them outside Seamesy.
Not an escrow service. Seamesy does not provide licensed escrow services, and the payment hold is not an escrow account, trust account or deposit account. Holding funds and releasing them in stages is a feature of the platform, run under these Terms, and is not a regulated escrow arrangement. Stripe's own terms also apply to the processing of your payment. Seamesy never stores your full card details.
Payout milestones. The Designer's payout (garment and shipping cost, plus any budget increase you paid, minus Seamesy's 5% platform fee) is released in two parts:
- Material Deposit (30%). 30% of the Designer's payout is sent to the Designer so they can buy fabric and supplies. It's sent once the order is paid. The Designer must not buy the fabric in the first 24 hours after payment, because you can cancel for a full refund in that time (section 12). The Designer should post a photo or video of the fabric they bought on the order page as soon as they've bought it: that fabric photo or video is the record that materials were bought. What happens to the deposit if the order is cancelled depends on who caused the cancellation and how far the order got (section 12). In short: if the Designer doesn't perform, they give it back and you're refunded in full; if you change your mind within 24 hours of paying, you're refunded in full; after 24 hours, or once the fabric photo or video is posted if that's sooner, the deposit is non-refundable and the Designer keeps it.
- Held balance (70%). The remaining 70%, plus any paid budget increase, stays with Seamesy until the piece is delivered and the 72-hour review window (section 10) ends without a reported issue, or until a reported issue is resolved under section 11.
Refunds. Any refund under these Terms goes back to your original payment method through Stripe, in US dollars. Refunds usually show within 5 to 10 business days, depending on your bank. If your bank converts the refund to another currency, the amount you see may differ slightly from what you paid because of exchange rates, which Seamesy doesn't control.
8. Making, delivery and customs
Order steps. Each order follows the same steps, in order: the Designer confirms your measurements, gets your approval of the fabric, cuts and sews, gets your approval of the finished piece, then ships it or hands it over, and you confirm you've received it. The Designer can only confirm your measurements after you've sent them and your payment is secured.
Fabric approval ("Implied Approval"). Before cutting, the Designer sends a photo or video of the actual fabric through the order page. You have 48 hours to approve it or request changes. If you do neither, the fabric is treated as approved and the Designer may begin cutting. If it's approved this way and you sent no chat message at all during those 48 hours, you give up the right to dispute the choice of that fabric later, including under Tier 2 in section 11. This covers only the fabric shown; it does not cover workmanship, design, fit, or a garment made from a different fabric.
If you supply your own fabric. You can choose to send your own fabric instead of having the Designer source it. When you send the request you tell us how it will reach the Designer (international shipping, local delivery or courier, or a drop-off by family or a local contact). Getting it to the Designer is your responsibility. Step two then becomes "Receipt of fabric": once it arrives, the Designer posts a photo or video of the fabric they received and you approve it or request changes, under the same 48-hour rule as above. Designers who don't source fabric can only accept requests where you supply your own.
Finished piece approval. When the piece is finished, the Designer posts a photo or video of it and asks for your approval. You can approve it or tap "Request changes" and say what needs fixing. Requesting changes pauses the 48-hour clock, and the piece can't be shipped or handed over, until the Designer posts an updated photo or video, which starts a fresh 48 hours. A chat message on its own doesn't pause the clock. If you neither approve nor request changes within 48 hours, the piece is treated as approved so the order can move on. You still have the 72-hour review window after delivery. If a Designer doesn't respond to a change request, message Seamesy support from the order page.
Delivery options. At checkout you choose international shipping to your address, Local Pickup, or delivery to a local address you nominate (for example, a family member or courier in Lagos or Accra). For international shipping you also choose the speed: Express Courier (such as DHL, FedEx or UPS, usually about 3 to 7 days in transit) or Standard Cargo (usually about 10 to 14 days in transit, and usually cheaper). These transit times are the carriers' typical estimates, not a promise by Seamesy or the Designer, and cargo in particular can take longer. Couriers and cargo agents charge by weight, so the Designer's quote shows the estimated package weight with the shipping cost. If the packed piece turns out to cost more to ship than quoted, the Designer can ask for the difference only as a Shipping/Logistics Correction under section 6. The Designer ships by the speed you chose unless you agree a change in the order chat. If you and your Designer agree in chat to switch a shipped order to Local Pickup, the Designer can change it before the piece leaves, and Seamesy refunds any shipping fee you paid that wasn't used. If you ask in chat, a Designer can also switch a Ready for Pickup order to delivery; this stops the 14-day pickup clock. If that delivery costs more than your order covers, the Designer asks for the difference as a Shipping/Logistics Correction under section 6, which you can approve or decline.
Proof of delivery. For an Express Courier shipment, the Designer must give a tracking number and post a photo of the shipping receipt or waybill. For Standard Cargo, they give a tracking number or, if the cargo agent only issues a paper waybill, a photo of that waybill, which is also posted in the order chat. For a local dispatch, they post a dispatch photo (such as the waybill or a confirmation from your nominee). For Local Pickup, they post a photo of the handover. Seamesy uses these records before releasing the Designer's final payout. Seamesy may check in through the order chat if a shipped order hasn't been marked received after 7 days. If you don't mark a shipped order as received, and haven't reported a delay or a problem, it is treated as delivered 21 days after shipping (30 days for Standard Cargo).
Who carries the risk until delivery. The Designer books and pays for shipping, so the piece is the Designer's responsibility until it's delivered: to the address you gave (as shown by the courier's tracking), to your nominee for a local dispatch, or into your hands (or Seamesy's, for Lagos Hub storage) for Local Pickup. After that it's yours. Designers are encouraged to buy the courier's insurance for valuable pieces.
Lost or damaged in transit. If tracking shows your parcel was lost, returned to the Designer, or damaged in transit, or it hasn't been delivered within 30 days of shipping and the courier can't find it, use "Report Customs/Shipping Delay" on the order page (which stops the automatic delivery clock) or message Seamesy support, before the order completes. If it arrives damaged, report it with photos within the 72-hour review window (section 10). Seamesy checks the tracking and the Designer's shipping records. If the piece didn't reach you for a reason that wasn't yours, you can choose between the Designer making and sending it again at their own cost, if they agree to, or a full refund under section 12 as a Designer non-performance cancellation. It's your responsibility, not the Designer's, if the piece couldn't be delivered because the address you gave was wrong or incomplete, you or your nominee refused or didn't collect it, or customs held it because duties or import taxes weren't paid. In those cases there's no refund, and any extra shipping cost is yours.
Late orders. The completion date in the quote is the Designer's commitment. If the piece hasn't been shipped or made ready for pickup 14 days after that date, and the delay isn't because the order was waiting on you (for example, for measurements, an approval or your fabric), you can choose to keep waiting or ask Seamesy to cancel the order. If you cancel, it's a Designer non-performance cancellation and you get a full refund under section 12. If you keep waiting, Seamesy may reduce the Designer's payout under section 13. Seamesy may also cancel an order on your behalf if the Designer stops responding for 7 days or more while the order is late.
Customs and shipping delays. If an international shipment (Express Courier or Standard Cargo) is stuck in customs or transit, use "Report Customs/Shipping Delay" on the order page. This pauses the automatic delivery clock, so the order won't be marked as received while the parcel is stuck, and tells the Designer in the chat. Mark the order as received once the piece arrives. Seamesy keeps an eye on paused orders and may restart the clock once the parcel is moving again; if it does, the order is treated as delivered 7 days later, or when the original 21 days (30 for Standard Cargo) are up if that's later, unless you mark it received or report an issue first. Local dispatch orders don't go through customs, so they can't be paused this way.
The 14-day pickup rule. For Local Pickup, you have 14 days from "Ready for Pickup" to collect the piece. If it isn't collected in that time, the order completes automatically, the held balance is released to the Designer (no handover photo is needed in that case), and the piece becomes your responsibility.
Seamesy Lagos Hub storage. If you can't collect a Local Pickup order in time, or want it shipped later, you can ask from the order page for Seamesy to store it at the Seamesy Lagos Hub for US$30 a month. Nothing is charged when you ask: Seamesy replies in the order chat with a payment link and arranges the drop-off with your Designer. By requesting storage you agree to pay the monthly fee, and you give up your 72-hour review window (section 10) so the Designer can be paid on time once the piece reaches the Hub.
- Custody. When the piece arrives, Seamesy photographs it and records its condition, and keeps it in a secure, dry, access-controlled space. Seamesy releases it only to you, or to a courier or person you name in your order's support chat, and records who it was released to and when (with the tracking number if it's shipped).
- Seamesy's responsibility. While the piece is at the Hub, Seamesy takes reasonable care of it. If it's lost or damaged at the Hub because Seamesy didn't take reasonable care, Seamesy will refund what you paid for the piece. Seamesy isn't responsible for normal wear from long-term storage (for example, creasing or slight fading), or for anything that was already wrong with the piece when it arrived, as shown in the arrival record. Your piece's condition on arrival is shared with you on request.
- Sending it on. Message Seamesy support when you want the piece shipped or collected. Shipping from the Hub is charged separately and quoted to you first.
- Unclaimed pieces. If a piece is unclaimed for 60 days in storage, Seamesy sends you a final notice in the order chat and by email. If you don't reply within 14 days of that notice, Seamesy may donate the piece to charity, and you'll have no further claim to it or to any refund. Seamesy keeps a record of when and where it was donated.
Customs. International orders may be subject to customs duties, import taxes or other charges set by the destination country. These are the buyer's responsibility and are not included in Seamesy's prices or fees.
9. Measurements and buyer responsibility
You are responsible for the accuracy of the measurements and sizing details you provide. Before work starts, the Designer confirms the measurements on the order, and they are then locked. If the Designer makes the garment accurately to the measurements you submitted but it doesn't fit because of a measurement error or a later change in body shape, no Alteration Credit or refund is given, the Designer receives their full payout, and any chargeback will be contested using the submitted measurement records.
10. The 72-hour review window
Every order has a 72-hour (3-day) review window. It starts when the order is marked "Delivered" or, for Local Pickup, when the piece is collected, and the time left is shown on your order page. Inspect your piece and, within that window, either confirm delivery (which releases the payment to your Designer straight away) or use "Report a Fit Issue" on the order page to report a defect, fit problem or difference from what was agreed. A fit issue report must include at least one photo showing the problem.
If no issue is reported before the window ends, the order completes automatically and the held balance is released to the Designer. After that, Seamesy's own dispute process (section 11) and cancellations (section 12) are no longer available for that order. Seamesy may also complete an order itself in limited cases, for example once a piece has been placed in Lagos Hub storage (section 8); that releases the held balance to the Designer in the same way.
Chargebacks. Nothing in these Terms takes away any right you have with your card issuer or bank, including the right to dispute a charge (a "chargeback"). Because a chargeback freezes the order's funds and takes weeks, please use the review window and Seamesy's dispute process first; they're usually faster and you keep the piece. If you file a chargeback, Seamesy will respond to your bank through Stripe with the order's records, such as your submitted measurements, your fabric and finished-piece approvals, tracking or handover photos, and the order chat, and the Designer's payout is held until the bank decides. If you get a refund from Seamesy and also win a chargeback for the same payment, you must repay the duplicate amount. Filing chargebacks for orders that were delivered as agreed may lead to your account being suspended (section 14).
11. No returns, and how disputes are resolved
Every piece on Seamesy is made to order, so there are no physical returns, and you are never asked to ship a piece back. If you report a valid issue within the review window, the payment stays held while Seamesy reviews your photos and both sides of the order chat, then resolves it as follows:
- Tier 1, minor fit issue caused by the Designer. An Alteration Credit (a partial refund taken from the Designer's payout) to cover local tailoring. You keep the piece.
- Tier 2, major error caused solely by the Designer (for example, the wrong fabric or design). With photo evidence, you receive a full 100% refund of everything you paid, including the Buyer Protection Fee, and you keep the piece. The Designer's payout is voided and the Material Deposit is recovered from the Designer (section 13). Your refund doesn't depend on that recovery. Not available for a fabric you approved, including by Implied Approval (section 8).
- Buyer measurement error. No credit or refund (section 9).
Both you and the Designer are told the outcome on the order page and by email.
12. Cancellations and refunds
Pieces are made to order, so a cancellation is handled by Seamesy, not by a button on the order page. To ask for one, message Seamesy support from the order page (or email support@seamesy.com) as early as possible. A problem with a delivered piece goes through sections 10 and 11 instead. Before you pay, you can simply decline or ignore a quote and nothing is charged.
What you get back depends on who caused the cancellation. The principle is simple: you're protected if the Designer doesn't deliver, and the Designer is paid fairly for materials and work if you change your mind.
If the Designer doesn't perform: full refund. This covers a Designer who stops responding, says they can't complete the work, misses the completion date as described in section 8 (Late orders), loses the piece in transit (section 8), has their store suspended or removed during the order, or makes a Tier 2 error (section 11). You get back 100% of what you paid for the order: the Designer's quote, the Buyer Protection Fee and any budget increase. The Designer keeps nothing; any Material Deposit already sent to them is recovered from the Designer under section 13. Your refund doesn't depend on that recovery.
If you change your mind after paying: Cancellations made within 24 hours of payment receive a full refund. After 24 hours, the 30% Material Deposit becomes non-refundable to cover the Designer's sourcing costs.
- Within 24 hours of payment (and before the Designer has posted the fabric photo or video): you get a full refund of everything you paid, including the Buyer Protection Fee. Designers are told not to buy fabric during these first 24 hours. Any Material Deposit already sent is recovered from the Designer under section 13.
- After 24 hours, or once the fabric photo or video has been posted, whichever comes first, and before cutting starts: the 30% Material Deposit is non-refundable. The Designer keeps it to cover sourcing the materials, and you get back the rest of what you paid except the Buyer Protection Fee. The materials stay with the Designer unless you agree otherwise in the chat.
- If you're supplying your own fabric: the Designer doesn't buy fabric, so after the first 24 hours and before cutting starts you get back everything except the Buyer Protection Fee. The Designer sends your fabric back to you at your cost, or hands it to someone you name.
- After cutting has started: a change-of-mind cancellation is generally not available, because the piece is being made for you. The Designer finishes it and you receive it as normal. If you and the Designer agree in the chat to stop anyway, Seamesy cancels the order on the terms you both agreed: the Designer keeps the agreed amount for materials and work done (at least the Material Deposit unless they agree to less), and you get back the rest except the Buyer Protection Fee.
If nobody is at fault. If an order can't go ahead for a reason outside both your control, or you and the Designer both agree to cancel before cutting starts, Seamesy refunds you everything you paid, including the Buyer Protection Fee, minus the Material Deposit if the Designer has already bought the materials.
How Seamesy decides. Seamesy decides which of these applies using the order record: the order steps and their dates, the fabric photo or video, tracking, and both sides of the order chat. Seamesy tells you both the outcome and the amounts in the order chat and by email. Refunds go to your original payment method (section 7). On a cancelled order, Seamesy doesn't take its 5% platform fee from what the Designer keeps. A completed order can't be cancelled; use the dispute process in section 11 within the review window instead.
13. Designers
Verification. Seamesy reviews each application, including the portfolio and social media, to confirm the work is the applicant's own. Before a store goes live, the Designer must give their full legal name, payout bank details and a clear photo of an official government ID that shows that legal name (for example, a National ID, Ghana Card or NIN slip, passport, driving licence or voter's card), and is asked for their storefront or workshop address (optional, kept private). Seamesy checks that these match before making the store public, and may ask for more verification at any time. Seamesy emails the Designer when their details are verified and the store goes live, or explains what needs fixing if they can't be verified. Until a store is live, its pieces are hidden from buyers.
Shipping quotes. Quote shipping from the real packed weight and the service the buyer chose, and build in a small buffer (for example 10 to 15%, or about 0.5 kg) for packaging and volumetric weight. A Shipping Correction (section 6) is an emergency measure for when the courier's weight still comes in heavier than you quoted. If the buyer declines it, you either ship at the original price and cover the extra yourself, or ask Seamesy to step in; Seamesy decides those cases and is not required to pay the difference. Repeated or inflated corrections may lead Seamesy to review your store.
Conduct. Designers must be the genuine maker or studio behind the pieces they show, keep their information accurate, and deal with buyers in good faith. Seamesy may suspend or remove a store that misrepresents its work, fails verification, or breaks these Terms.
Deadlines. Designers are expected to ship, or have the piece ready for pickup, by the completion date in their quote. Seamesy may deduct up to 5% from a Designer's remaining payout on an order delivered late, at its discretion, taking into account whether the delay was caused by waiting on the buyer (for example, for measurements or an approval) and the Designer's overall delivery record.
Material Deposit and refunds. The Material Deposit is for buying the materials for that order. Post the fabric photo or video on the order page as soon as you've bought them: it's the record that materials were bought if the buyer later changes their mind (section 12). If an order is cancelled because you didn't perform, or a Tier 2 error is found (section 11), or the buyer cancels within 24 hours of paying (before you've posted the fabric photo or video), the deposit already sent to you is owed back to Seamesy. That's why you must not buy fabric in the first 24 hours after payment. After 24 hours, or once you've posted the fabric photo or video, the deposit is yours to keep if the buyer changes their mind. Seamesy won't ask you to send US dollars back: it recovers the amount by deducting it from your next payouts on Seamesy until it's covered, and you can also choose to repay it by bank transfer to Seamesy. While an amount is owed, Seamesy may limit how many new orders you can take, or require the fabric photo or video before sending your next deposit. If a Designer abandons orders or doesn't deal with Seamesy in good faith, Seamesy may suspend or remove their store and pursue the amount owed.
Chargebacks. If a buyer files a chargeback, Seamesy holds your payout for that order until the bank decides and may ask you for evidence, such as the shipping receipt, tracking or handover photo. If the bank decides against Seamesy because of something you did or didn't do (for example, no proof of delivery, or a piece that wasn't what was agreed), Seamesy may recover the amount it lost from your payout for that order or your future payouts.
Store status. Only Seamesy can change whether a store is approved, live, suspended or removed. A store that isn't live can't receive requests.
14. Keeping orders on Seamesy
Keep communication respectful and on Seamesy. Don't share phone numbers, emails or social handles to move an order off the platform, or ask for payment outside Seamesy; doing so removes the protections in these Terms. Sharing a tracking number or a delivery address for your order is fine. Our chat filter may hold a message that looks like off-platform contact until the Seamesy team reviews it, and a held message is only delivered if it's approved.
Seamesy may suspend an account (it can still sign in and see its orders, but can't send messages, requests or orders, and a Designer's store is hidden) or ban it (no sign-in) if it harasses or defrauds others, tries to move orders off-platform, or otherwise abuses Seamesy. Seamesy emails you if your account is suspended, banned or restored.
Blocking. You can block a buyer or Designer from an order page. A block stops the two of you from starting any new order together, in either direction. On an order you already share, the text chat closes in both directions, but the order itself stays open so the held payment can still be completed or refunded properly: the order steps still work, the Designer can still post photos or videos of the piece, and both of you can still message Seamesy support. Seamesy reviews and steps in on that order if needed. You can see and undo blocks under Account → Blocked accounts.
15. Reviews and content
Reviews must reflect a genuine completed order and your honest experience. A review shows your name, your state or region and country, and your rating. Seamesy may remove reviews or other content that are fraudulent, abusive or break these Terms. By posting content (including reviews, photos and messages), you let Seamesy display it on the platform in connection with the order or Designer it relates to.
16. Intellectual property
Designers keep ownership of the designs and images they upload, and are responsible for having the right to use and sell them. The Seamesy name, logo and site design belong to Seamesy and may not be used without permission.
17. Reporting a problem and Seamesy support
If something goes wrong (a Designer stops responding, a piece doesn't match what was agreed, or you have a safety or fraud concern), use "Report" on your order page, message Seamesy support, or email support@seamesy.com. Reports go to the Seamesy team only. We may pause a payment release, suspend a store or take other action while we look into it. Issues with a delivered piece must still be reported within the 72-hour review window (section 10).
Seamesy support chat. Each order has a private chat between you and Seamesy, separate from the chat with the other party, who can't see it. Replies there come from the Seamesy team and show as "Seamesy support". Seamesy may mark a support chat resolved; writing in it again reopens it. Seamesy may also post in the main order chat, to both of you or to one of you privately, when that helps the order.
18. Disclaimers
Seamesy is provided "as is" and "as available." We vet Designers before their stores go live, but we can't guarantee the quality, fit, timeliness or legality of any piece a Designer makes. Your agreement for the making of the piece is with the Designer; Seamesy's role is to facilitate the request, payment, communication and dispute process described in these Terms.
Fulfillment is the Designer's responsibility. Because Seamesy is an intermediary and does not make, measure, cut, sew or ship pieces (section 2), to the fullest extent permitted by law Seamesy accepts no liability for: a late or delayed delivery; a piece that is damaged, ruined, badly made, lost or delayed in transit or customs; or a piece that isn't ready in time for a wedding, party or any other event or deadline. These are matters between you and the Designer. Your remedies for them are the ones in these Terms: the review window in section 10, the dispute process in section 11, and cancellations in section 12, including a full refund if the Designer doesn't perform. If a date matters to you, build in extra time and agree it with your Designer before you accept the quote.
19. Limitation of liability
No indirect or emotional damages. To the fullest extent permitted by law, Seamesy is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for emotional distress, mental anguish, inconvenience, loss of enjoyment, a missed or spoiled event, lost profits, lost earnings or lost opportunity, arising from your use of the platform or from an order between you and a Designer, even if Seamesy was told such damages were possible.
Liability cap. To the fullest extent permitted by law, Seamesy's total liability to you for all claims relating to an order, however they arise (in contract, negligence or otherwise), is limited to the platform fees Seamesy actually collected on that order. For a buyer, that's the Buyer Protection Fee you paid (9% of the Designer's quote); for a Designer, it's the 5% platform fee taken from your payout. Seamesy is not liable for the full price of the garment, the cost of replacing it, or any amount beyond those fees. For a claim that isn't about a specific order, Seamesy's total liability is limited to the platform fees you paid Seamesy in the 12 months before the claim arose.
What the cap doesn't change. The cap doesn't reduce a refund, Alteration Credit or cancellation refund you're owed under sections 8, 11 and 12, or Seamesy's responsibility for a piece in Lagos Hub storage (section 8). Those are paid under those sections, not limited by this one. Nothing in these Terms limits liability that can't be limited by law, such as for Seamesy's fraud.
20. Termination
You may stop using Seamesy at any time. We may suspend or close an account that breaks these Terms, puts other users at risk, or for other legitimate business reasons, with notice where reasonably possible. Open orders are still handled under these Terms.
Archived and deleted orders. Archiving an order only hides it from your own orders list; it isn't deleted and the other party isn't affected. Orders with no payment held and no activity for 90 days are archived automatically and come back if anyone writes in them. Seamesy may permanently delete an order created in error or for testing, or remove an order as part of a deletion request (see the Privacy Policy). Deleting an order doesn't refund or reverse a payment on its own; any refund owed is handled separately.
21. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, let you know. Using Seamesy after the changes take effect means you accept the updated Terms.
22. Governing law and disputes with Seamesy
Governing law. These Terms, and any dispute between you and Seamesy, are governed by the laws of the State of New York, USA, and the U.S. Federal Arbitration Act, without regard to conflict-of-law principles.
Talk to us first. Before starting a claim against Seamesy, email support@seamesy.com with your name, your order number (if any) and what you're asking for. We'll try to resolve it with you informally within 30 days. Problems between a buyer and a Designer over an order go through Seamesy's dispute process in section 11, not this section.
Mandatory arbitration. If we can't resolve it within 30 days, you and Seamesy agree that any dispute or claim relating to these Terms, the platform or an order will be settled by final and binding individual arbitration, not in court. Arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or its Commercial Arbitration Rules, for a Designer acting as a business), before a single arbitrator. It will take place in New York City, New York, or by video call or written submissions if the arbitrator allows. Filing and arbitrator fees are paid as set out in the AAA's rules. The arbitrator must follow these Terms, including section 19, and can award the same individual relief a court could, but only for you.
Small claims court. Instead of arbitration, either you or Seamesy may bring an individual claim in small claims court in New York City, or in the county where you live if that court has jurisdiction, as long as the claim stays there and is only on your own behalf.
No class actions and no jury. You and Seamesy each bring claims only individually, not as a plaintiff or class member in any class, collective or representative action, and the arbitrator can't combine claims from more than one person. You and Seamesy each give up the right to a jury trial.
Opting out. You can opt out of this arbitration agreement by emailing support@seamesy.com within 30 days of first accepting these Terms, with your name, your account email and a clear statement that you're opting out of arbitration. If you opt out, or if any part of this arbitration agreement is found unenforceable for a claim, that claim will be heard only in the state or federal courts in New York County, New York, and you and Seamesy agree to those courts' jurisdiction.
Where local law applies. If you live in a country whose consumer protection law gives you rights that can't be waived by agreement (for example, the right to bring a claim in your local courts), nothing in this section takes those rights away.
